O-2 visa applicants can be authorized to work in the US in support of a principal O-1 artist.

The O-1 visa is designed specifically for individuals who possess extraordinary ability in the arts, and it allows these talented artists to work in their field for a maximum of 3 years while in the US.

Who Qualifies for an O-1 Visa?

To be eligible for an O-1 visa, an artist must demonstrate extraordinary ability by sustained national or international acclaim. This can be established through various forms of recognition such as awards, critical reviews, news articles, and testimonials from recognized experts in the field. The applicant should be coming to the US to continue work in the area of extraordinary ability and their intention to work in their established field is a critical component of the application.

Key Eligibility Criteria Include:

  • Recognition and Awards: International prizes or national awards, critical reviews and media coverage, and letters of recommendation from prominent figures providing detailed insights into the artist’s impact on the field.
  • Leading Roles: Participation in a major or headline role in important productions or events, including notable albums, festivals, broadcasts, events, etc.; or for important organizations or establishments, including notable venues, labels, companies, etc.
  • Commercial or Critically Acclaimed Successes: Proof of success in the field through record sales, streaming numbers, scored reviews, or other achievements.
  • High Remuneration: Proof that the artist has been or will be paid highly compared to others in their field.

O-2 Visa: Essential Support Personnel

The O-2 visa is specifically for individuals who accompany an O-1 visa holder. These individuals must demonstrate that they are essential to the completion of the O-1 visa holder’s production or event and have skills and experience with the O-1 that cannot be readily performed by a US worker. This visa is particularly relevant for supporting musicians, tour managers, sound engineers, lighting designers, and all others working on stage or behind the scenes to support an O-1 artist in the US.

P-1/P-1S Visa Petitions

P-1 visas are for members of internationally recognized entertainment groups, such as bands, orchestras, or theater companies. P-1S visa applicants can be authorized to work in the US in support of a principal P-1 group.

P-3/P-3S Visa Petitions

P-3 visas are for “culturally unique” artists or groups. “Culturally unique” is usually interpreted as art that is distinct to a specific geographic place, cultural or ethnic tradition, or group of people. P-3S visa applicants can be authorized to work in the US in support of a principal P-3 artist or  group.

Consular Processing

Once a visa petition is approved, we can assist you in completing the US government’s DS-160 application form and arranging your visa interview or mail-in procedure at your local US consulate.
